Preparing for the first Egyptian Cyber Crimes Law
With the increase of computer usage and data, as well as information networks and the swelling in the numbers of users of these technological means in conducting commercial and services transactions to a great extent and the development in the skills and methods of using these modern technological systems, a number of individuals has developed means to subjugate these techniques to serve their personal aims and aspirations.
These aims can be illegal and against the law, morals, principles and justice. They can also affect the national economy negatively and result in massive losses to the users of these new modern technologies. The Ministry of CIT has always been innovative in preparing the legislative environment to embrace the usage of such modern technological methods by providing the perfect climate for applications and to ensure the efficiency and effectiveness of appliances, as well as guarantee the investments channeled to this information sector, which has become one of the indicators of progress and prosperity of a society.
To illustrate this we mention the following laws:
- Intellectual Property Rights - Law 82 for the year 2002
- Regulating e-signatures - Law 15 for the year 2004
- Organization of communication - Law 10 for the year 2003
Considering the abstract nature of cyber crime, which lacks the usual traditional laws to govern it, ITIDA has taken up the procedures which led to passing the Ministerial Decree 327 for the year 2005 to establish a national committee comprised of legislators, jurists, lawyers and technical experts to propose the law for information security and cyber crime. This law shall be a safety fence against the abusers of technology, inattentive and oblivious of the law. This will enable the law to put them on trial and allow the investigative powers of the society to make them accountable for their crimes. It will also protect the society and the economy as well as investments in the field.
